CHARLESTON, W.Va. — After Jospeh Kubican had his face kicked in at the former Bubba’s Bar and Grill in Bridgeport, he needed the state Supreme Court’s help.
He argued in Harrison County Circuit Court that Bubba’s was negligent in failing to provide a safe environment or intervene in the 2011 beating. His alleged assailant, Harry Wiseman, beat him once, went back to sip his drink as Kubican laid unresponsive on the floor, was not ejected from the bar, then returned to kick Kubican’s face repeatedly, according to allegations in court documents.
“Bubba’s” was a business name for “The Tavern, LLC.” Court documents state its owners used the bar’s accounts to buy things like meals, chiropractic treatments and a trip to Myrtle Beach, even after the bar closed down in June 2011.
