CHARLESTON, W.Va. — State tax forms for next year’s filing season will be updated to reflect the state’s recent acceptance of same-sex marriage.

Not only will gay and lesbian couples be able to file jointly next year like heterosexual couples, but same-sex couples who were already legally married in other states during the last three years will be able to update their previous tax returns to reflect their married status.

Gov. Earl Ray Tomblin and Attorney General Patrick Morrisey announced Oct. 9 they would no longer defend the state’s same-sex marriage ban after the U.S. Supreme Court refused to hear a defense of a similar bans in surrounding states. Tomblin also said at the time he would direct all state agencies to take appropriate action to comply with the decision.
