CHARLESTON, W.Va. — A dog’s life was saved Thursday after the West Virginia Supreme Court of Appeals overturned a decision that would result in the dog’s death.

The High Court determined that the Ninth Circuit Court erred in its determination that Bluefield Municipal Court had the authority to euthanize the dog.

According to the court’s decision, issued on Thursday, municipal courts do not have authority to kill a “vicious” dog.

The court found Bluefield Ordinance 4-49 “void to the extent that it allows a municipal court to order the destruction of a dog.”

The case was brought about after a complaint of a dog running at large and another with inadequate shelter brought Animal Control Officer Randall Thompson to the home of Estella Robinson.
