BECKLEY, W.Va. — Daniel Hall confirmed Monday morning that he has resigned from the state Senate to take a lobbyist position with the National Rifle Association.
Hall, who was elected as a Democrat to the Senate in 2012 to represent Wyoming, Raleigh and McDowell counties, switched parties in 2014 in the “red tide” that swept the state and caused a tie in the Senate membership. Hall’s flip gave the majority to the Republicans for the first time in 80 years.
A portion of the state code says that a list of potential replacements should come from “the party executive committee of the party with which the person holding the office immediately preceding the vacancy was affiliated,” which would mean a Republican.
However, later in the code, it says “the party executive committee of the state senatorial district in which the vacating senator resided at the time of his or her election or appointment,” which means his replacement could be a Democrat…
