West Virginia State Police submits $1 million settlement in wrongful death case

MARTINSBURG, W.Va. – A $1 million dollar settlement has been approved by a Kanawha County judge in the case of the death of Edmund Exline, a 45-year-old who died in West Virginia State Police custody in February 2023.

Filed in July 2023, the lawsuit accused three State Troopers of using excessive force when they encountered Exline walking alongside Interstate 81 outside of Martinsburg, tackling him to the ground and immobilizing him with a stun gun until he became unresponsive, before putting him in the back of their state police vehicle. Exline was unarmed.

According to the complaint, the trio pulled him from the vehicle when they realized he was unresponsive before administering Narcan multiple times, even though Exline had not overdosed.

A report from WVSP at the time of the incident said that the troopers responded to a call about an intoxicated man walking along the interstate, and that Exline was walking into traffic.

Exline was taken to Berkeley Medical Center, where he was pronounced dead that same evening.

Charleston attorney John-Mark Atkinson with Atkinson & Frampton represented Exline’s family through the case.
