CTUB wins territory dispute with American Water; PSC judge: contested development ‘exclusive’ to CTUB

CHARLES TOWN, W.Va. — The Charles Town Utility Board was handed a victory last week in a territorial dispute with West Virginia American Water. At issue was which utility would be permitted to provide water service to a large mixed-use development planned for construction off Keyes Ferry Road near Charles Town.

After considering witness testimony from a July 30 hearing and written arguments submitted in August, Keith George, an administrative law judge with the Public Service Commission of West Virginia, issued a Sept. 11 decision concluding that the development in question “is in the exclusive territory of CTUB.”

“CTUB is extremely pleased with the decision,” said CTUB general manager Kristen Stolipher in a written statement. “It demonstrates that utility-on-utility competition is contrary to the public interest and that WVAW is improperly infringing on CTUB’s service territory.”
