BLUEFIELD, W.Va. — A seemingly defunct lawsuit against the Mercer County Bible in the Schools program continues on today when a federal court in Richmond, Va., hears oral arguments in an appeal by a plaintiff in the case.
Elizabeth Deal and her daughter, Jessica Roe, are appealing a November 2017 ruling that stated they did not have standing to sue the school system. The two are asking to have their injury recognized, nominal damages and assurances the classes will not resume.
The arguments will be heard in the 4th U.S. Circuit Court of Appeals in Richmond, Va.
