CHARLESTON, W.Va — West Virginia Secretary of State Mac Warner has agreed to publish the full texts of the two proposed constitutional amendments on the Nov. 6 general election ballot as legal ads in state newspapers to stave off a threatened lawsuit by retired state employee and attorney Thornton Cooper.
“They are going to publish the full texts,” Cooper said Thursday after negotiations with Steve Connelly, deputy secretary of state and general counsel, and Curtis Capehart of the Attorney General’s Office.
Earlier this month, Cooper sent notice to Warner and Attorney General Patrick Morrisey of his intent to bring legal action to require publication of the full texts of the proposed amendments, as required by the West Virginia Constitution and state law. Under the law, the full text of proposed amendments up for voter approval are to be published as legal ads in at least one newspaper in each county.
