CHARLESTON, W.Va. — The Charleston Gazette-Mail has asked a federal court to unseal more than a dozen documents that were filed as part of former Massey Energy CEO Don Blankenship’s effort to have his criminal mine safety conviction overturned.
On Wednesday, the newspaper, now part of HD Media, filed a motion to intervene in the case for the purposes of arguing that the records should be available to the press and the public.
“In this case, if the parties are permitted to keep publicly filed documents under seal, the Charleston Gazette-Mail and other members of the press and the public will be prevented from obtaining meaningful information regarding this newsworthy case from court records,” wrote Sean McGinley, a Charleston lawyer who represents the Gazette-Mail.
