Judge delays W.Va. same-sex marriage ruling

CHARLESTON, W.Va. — A federal judge has again put a hold on his decision in a lawsuit challenging West Virginia’s ban on same-sex marriage.

U.S. District Court Judge Robert C. Chambers stayed the case in West Virginia, pending a decision by the U.S. Supreme Court.

The high court has been asked to review the 4th Circuit Court of Appeals decision that Virginia’s ban on same-sex marriage is unconstitutional, but it’s not clear when that will happen.

“It’s disappointing that the court decided to hold off on ruling,” said Beth Littrell, attorney for three same-sex couples who filed the lawsuit in West Virginia. “It’s not surprising, but we believe that [Chambers] has enough information and, certainly, there is a great deal of authority now for a decision.

“Justice delayed is justice denied, and our couples certainly would appreciate a decision about their case, sooner rather than later.”

Chambers wrote in an order filed Tuesday that, “because of the overlap in issues,” the case will be on hold until the Supreme Court makes a ruling.

In June, Chambers stayed the case pending a decision from the 4th Circuit in the challenge to Virginia’s ban on same-sex marriage.

The appellate court ruled in July that the Virginia ban is unconstitutional, leaving many to believe a decision from Chambers was imminent…
