Auction of Fairmont’s Middletown Mall cancelled

FAIRMONT, W.Va. — The Middletown Mall was set to go up for public auction Tuesday afternoon at the Marion County Courthouse.

A legal ad previously ran in the Times West Virginian stating that a sale of the property on which the Middletown Mall stands was to be held at 1:30 p.m. Tuesday.

Prior to the start time, the auction was cancelled and not rescheduled, the attorney in charge of the sale, J. Scott Tharp, said.

 Pin Oak Properties, LLC entered into an agreement on Dec. 22, 2005, with Branch Banking and Trust Company (BB&T) to purchase the property, the legal ad said.

According to the legal ad, Pin Oak Properties LLC defaulted under the terms of the agreement, which led to BB&T requesting the possible auction.
